Terms and Conditions

Here you will find the general terms and conditions of “Think 2 Escape”. When you enter the facility of “Think 2 Escape”, you agree to the terms, conditions and house rules of “Think 2 Escape” as described below. The general terms and conditions are available for inspection at the reception.

Article 1: Definition of terms

The following definitions apply in these General Terms and Conditions:

  1. “Think 2 Escape”: The organization that builds escape rooms and offers them to Clients to be played.
  2. the Client: one or more natural persons who wish to participate in playing one of the escape rooms offered by “Think 2 Escape”.
  3. Personnel: Natural persons who have an employment relationship with “Think 2 Escape” or provide services on a voluntary basis at the “Think 2 Escape” arrangement.
  4. Participant: A natural person who participates in playing one of the escape rooms offered by “Think 2 Escape”.
  5. Shift, round, time slot: The time in which a certain escape room of “Think 2 Escape” is played according to the definition of “Think 2 Escape”.

Article 2: General

  1. These General Terms and Conditions always apply to all agreements or deals ‚ÄúThink 2 Escape‚ÄĚ makes with a Participant or Customer.
  2. The Client is expected to arrive in time. Time lost due to delays cannot be compensated.
  3. Participation in an escape room of “Think 2 Escape” is entirely at the Customer’s own risk. “Think 2 Escape” is not responsible for accidents and / or injuries caused by using one of the escape rooms offered by “Think 2 Escape”.
  4. If one is pregnant or possibly has a chance of having an epileptic seizure, “Think 2 Escape” requests that this be reported to the staff of “Think 2 Escape” in advance.
  5. It is not permitted to bring consumptions (drinks, food, etc.) into an escape room of “Think 2 Escape”.
  6. It is not permitted to take open or unpacked/broken consumptions (drinks, food, etc.) into the facility of “Think 2 Escape”.
  7. All puzzles in a ‚ÄúThink 2 Escape‚ÄĚ escape room are made in such way that they are easy to open when you solved the puzzle and have the right combination. It is therefore not allowed to open puzzles or locks by force. In the event that puzzles and / or property are damaged or destroyed, “Think 2 Escape” must be compensated by the Participant or Customer who caused the damage.
  8. “Think 2 Escape” has the right to take last-minute promotions, as a result of which the price may differ from the price the Customer has seen on the website. “Think 2 Escape” can do this, for example, when there are still open time slots in the day schedule. The Customer is not eligible to receive the missed discount.
  9. A Participant’s or Customer’s failure or refusal to comply with or violate the terms and conditions described in this document may result in a claim for damages and / or a fine at the address of a Participant or the Customer.
  10. It is forbidden for anyone except staff of “Think 2 Escape”, to enter or stay at the facility of “Think 2 Escape” outside opening hours.
  11. “Think 2 Escape” has the right to change opening days and / or times.
  12. With the exception dogs how guide blind or disabled people, pets are not permitted at the facility of “Think 2 Escape”. These assistance dogs must be clearly recognizable.
  13. Selling and / or distributing goods at the facility of “Think 2 Escape” is not permitted without prior written permission from “Think 2 Escape”.
  14. It is not permitted to enter the facility of “Think 2 Escape” with bicycles, skates, a scooter or other vehicles, with the exception of a wheelchair or prams.
  15. In the event of theft, “Think 2 Escape” will contact the police at all times.
  16. Participants must at all times wear at least a shirt, trousers or skirt and footwear even at high temperatures. A Participant may be refused access to the facility of “Think 2 Escape” if the Participant in question does not comply with this. The Participant in question is in that case not entitled to a refund.
  17. A Participant may be denied access to the facility of “Think 2 Escape” if the Participant in question wears inappropriate clothing, which harms the family atmosphere of “Think 2 Escape”. The Participant in question is then not entitled to a refund.
  18. A Participant may be denied access to the facility of “Think 2 Escape” if the Participant in question wears clothing with inappropriate or offensive texts or images, which harms the family atmosphere of “Think 2 Escape”. The Participant in question is then not entitled to a refund.
  19. A Participant may be denied access to the facility of “Think 2 Escape” if the Participant in question wears clothing that could be a security risk.
  20. A Participant may be denied access to the facility of ‚ÄúThink 2 Escape‚ÄĚ if the Participant in question is wearing clothing that is in conflict with clothing regulations that apply in public places.
  21. A Participant may be refused access to the facility of “Think 2 Escape” if the Participant in question is wearing a face-cover in any way and is therefore not recognizable.
  22. Persons who wish to enter the facility of “Think 2 Escape” in disguise or in (sports) club clothing can be refused access and / or removed from the facility of “Think 2 Escape” without any right to a refund.
  23. “Think 2 Escape” does not accept any responsibility for any damage suffered by the Customer, unless this damage is the direct result of intent or gross negligence on the part of “Think 2 Escape” or Staff ¬†present at “Think 2 Escape”.
  24. If the Customer or a Participant has been harmed and / or injured, the Customer or the Participant must make this known to the Staff of ‚ÄúThink 2 Escape‚ÄĚ before leaving the facility of “Think 2 Escape”. “Think 2 Escape” is no longer responsible if the notification takes place after leaving the facility of “Think 2 Escape”.
  25. In all cases where these regulations do not provide, the management of “Think 2 Escape” will decide.
  26. “Think 2 Escape” has the right to change, refuse or cancel an order or reservation without giving any reason. The Client will be notified as soon as possible by E-Mail.
  27. The customer may not cause any inconvenience to other customers, participants, local residents, bystanders and / or staff of ‚ÄúThink 2 Escape‚ÄĚ.
  28. No activities may be performed in the “Think 2 Escape” escape rooms other than activities that reasonably belong in an escape room. Activities that are NOT allowed include: intimate activities, intimidation, violence, discrimination and / or drug use.

Article 3: Ascendency

  1. If ‚ÄúThink 2 Escape‚ÄĚ cannot fulfill its obligations to the Client due to a non-attributable shortcoming (force majeure), the fulfillment of those obligations will be suspended for at least the duration of the force majeure situation. The Client has the choice to make a new appointment to still perform the agreement or to request a refund if the Client has already paid.
  2. A shortcoming “Think 2 Escape” cannot be charged if it is not due to its fault, nor under law, legal act or generally accepted views at its expense.
  3. In the event of force majeure, the Client is not entitled to any compensation.

Article 4: Payment

  1. If the Client does not pay for the ‚ÄúThink 2 Escape‚ÄĚ escape room before the start of the game, ‚ÄúThink 2 Escape‚ÄĚ cannot grant the Client access to the relevant escape room.
  2. All costs that ‚ÄúThink 2 Escape‚ÄĚ must make in order to collect the amount due by the other party are for the account of the other party.
  3. The price that the Customer must pay before starting, is the price that is stated on the website on the day of reservation by the Customer unless ‚ÄúThink 2 Escape‚ÄĚ gives a discount.

Article 5: Changes

  1. If the Client wishes to take an additional Participant with him or her, this can be done up to the maximum number of persons indicated by ‚ÄúThink 2 Escape‚ÄĚ for the relevant escape room.
  2. If all participants wish to pay for themselves, the amount of the escape room is divided over the number of participants present.
  3. If more than the maximum number of allowed participants for the ordered the escape room arrives, ‚ÄúThink 2 Escape‚ÄĚ will do its best to find a solution that sought the situation that has arisen.
  4. If no solution is found, the participants must decide for themselves who does and does not participate in the escape room.

Article 6: Liability

  1. Participation in an escape room of “Think 2 Escape” is at your own risk.
  2. “Think 2 Escape” accepts no liability for damage resulting from an accident, loss or theft caused to participants during the presence in the facility of “Think 2 Escape” unless it can be demonstrated that the damage or the injury was caused by “Think 2 Escape” or “Think 2 Escape” Personnel.
  3. Although “Think 2 Escape” has taken precautions to prevent the loss or theft of money or property of the customer, “Think 2 Escape” assumes no liability for the loss of or damage to money or property of the Customer or a Participant
  4. “Think 2 Escape” accepts no liability for the costs already incurred by the participants as insurance premiums ore likewise if a reservation must be canceled.
  5. If due to force majeure (in the broadest sense of the word) ‚ÄúThink 2 Escape‚ÄĚ cannot fully or partially meet its obligations, ‚ÄúThink 2 Escape‚ÄĚ will do everything that is reasonable and in its power to live up to its obligation. If extra costs have to be made, this will be done in consultation and the settlement will take place by means of subsequent calculation.
  6. If a Customer arrives too late for his or her arrangement, the consequence will be that the time lost may not be made up or compensated.
  7. If a Customer is not present at least 5 minutes in advance of his or her arrangement and ‚ÄúThink 2 Escape‚ÄĚ did not hear anything from him or her, the reservation of this customer will be canceled and the time slot can be offered to other customers of ‚ÄúThink 2 Escape‚ÄĚ.
  8. “Think 2 Escape” is not liable for damage to property or loss of property of the Customer.
  9. The Customer closing the agreement is hold responsible for all obligations towards “Think 2 Escape” that will come with this agreement.
  10. If a Customer wishes to park a car at the parking lot of “Think 2 Escape”, he may do so at his own risk. “Think 2 Escape” is not responsible for damage suffered in the event of a burglary or theft. This also applies if the damage is caused by storm, fire, hail, explosion or other extraordinary events.

Article 7: Termination of the Agreement

  1. “Think 2 Escape” can immediately cease the continuation of the game and thus terminate the agreement, if the customer causes such hindrance that it is not reasonable to expect “Think 2 Escape” to continue the activity. In that case ‚ÄúThink 2 Escape‚ÄĚ can order the Participant (s) concerned to immediately leave the escape room or the facility.
  2. In a case as referred to in paragraph 1 of article 7, “Think 2 Escape” is not obliged to compensate the Participant for any damage or to return payment.

Article 8: Payment

  1. Payments by the Customer to ‚ÄúThink 2 Escape‚ÄĚ must be made with a generally accepted payment method in the Netherlands, including generally recognized forms of electronic payments.
  2. “Think 2 Escape” is entitled to promote payments which do not need change.
  3. “Think 2 Escape” is not obliged to accept a quantity of coins as payment. Counting such an amount causes a disproportionate delay.
  4. “Think 2 Escape” is entitled to terminate the agreement immediately if the Customer cannot meet the required payment for the ordered escape room.
  5. If due to WiFi failure or defect of the customer’s mobile phone it is not possible to use apps or websites, ‚ÄúThink 2 Escape‚ÄĚ accepts no liability and the Customer is not entitled to a refund.
  6. If due to technical malfunctions of any kind, as a result of which the payment cannot be processed, authorized or not processed correctly and / or authorized in time, ‚ÄúThink 2 Escape‚ÄĚ accepts no liability whatsoever. The Client is not entitled to reimbursement.
  7. Payment can be made at the cash register by cash, pin or credit card (not an AMEX).

Article 9: Lost property

The following applies to found objects with regard to the obligation to declare and report, and the taking into custody by law:

  1. The Customer is obliged to notify ‚ÄúThink 2 Escape‚ÄĚ as soon as possible in case an object or sum of money found by the Customer at the facility of¬† ‚ÄúThink 2 Escape‚ÄĚ. “Think 2 Escape” is authorized to accept and hold such an object or sum of money to return it to the rightful owner. If the finder keeps the found object or sum of money with him, he / she is obliged to do all that can reasonably be required of him / her to find the rightful owner to return the object or sum of money.
  2. “Think 2 Escape” is authorized to sell a found object after 3 months or, if the item is not suitable for storage, earlier, insofar as it concerns not expensive items.
  3. ‚ÄúThink 2 Escape‚ÄĚ is obliged to hand over a found object, the proceeds of an object sold pursuant to paragraph 2 of this article or the amount of a found sum of money to the person entitled, if he or she claims the object or sum of money within 3 years after reporting the loss. If the person entitled claims the proceeds from the sale of a found object, “Think 2 Escape” may deduct the custody fee and the administration costs from that proceeds.
  4. ‚ÄúThink 2 Escape‚ÄĚ may charge a handling fee for handling a request regarding a lost item or sum of money.

Article 10: Intellectual Property Rights

  1. All rights of intellectual property with regard to the name, logo and text of “Think 2 Escape” as well as with regard to the program and business formula used by “Think 2 Escape” are generally held by “Think 2 Escape ‚ÄĚ
  2. The Client is not permitted to make this public and / or to reproduce it or use it in any other way, except with the prior express permission of “Think 2 Escape”.
  3. It is forbidden to take photos or other images from or in an escape room of “Think 2 Escape” without permission from “Think 2 Escape”.

Article 11: Privacy and security

  1. “Think 2 Escape” attaches great importance to the privacy and security of its customers.
  2. “Think 2 Escape” likes to take group photos and place them on the website and / or Facebook page of “Think 2 Escape”. Customers must indicate whether they want this or not. The Customers wishes in this matter will be respected by ‚ÄúThink 2 Escape‚ÄĚ
  3. If a Customer initially had no objection but later indicated that he did, “Think 2 Escape” will make a reasonable effort to remove the photo in question from the relevant media.
  4. “Think 2 Escape” cannot be held responsible if other media are slow or unresponsive to the “Think 2 Escape” request to delete certain photos.
  5. Every Customer or Participant must be able to identify themselves when Personnel of “Think 2 Escape” so requests.
  6. If a Customer or Participant cannot or refuses to identify him or herself, “Think 2 Escape” may decide to remove the Customer Participant in question from the facility of “Think 2 Escape”, without any right to a refund and / or other type of reimbursement. The police can be asked for assistance if necessary.
  7. In the context of the general safety of all Customers, Participants and Personnel of “Think 2 Escape”, a Customer or Participant may be asked to agree to a visitation and / or search of his bag, suitcase or other baggage brought by the Customer or Participant. If the relevant Customer or Participant refuses this request, “Think 2 Escape” may decide to remove the Customer or Participant in question from the facility of “Think 2 Escape”. The Customer or Participant concerned is not entitled to a refund in this case. The police can be brought in if necessary.
  8. In a situation where public order is disturbed or there is an unsafe situation, “Think 2 Escape” is entitled to close the facility of “Think 2 Escape” immediately and deny the Customer and/or Participants access to the facility “Think 2 Escape”. The rules for force majeure as described in these general terms and conditions apply to such an incident.
  9. “Think 2 Escape” is obligated at all times to remove a Customer or Participant who violate these regulations, or if “Think 2 Escape” deems this necessary, from facility of “Think 2 Escape ‚ÄĚ. The Customer or Participant concerned is not entitled to a refund in this case. The police can be asked to assist if necessary.
  10. “Think 2 Escape” indicates that at the facility of “Think 2 Escape” there is camera surveillance to protect the Customer and Participants of “Think 2 Escape” and their property.
  11. For general safety, the Customer and Participants must follow the instructions of our “Think 2 Escape” Personnel.
  12. Safety is a priority for “Think 2 Escape”. Participants and Customers are required to obligated by follow the rules described in these Terms and Conditions and must promptly follow the instructions given by ‚ÄúThink 2 Escape‚ÄĚ Personnel.
  13. Physical and / or verbal abuse, or otherwise undesirable behavior towards Participants or Personnel of “Think 2 Escape” will NOT be tolerated. Participants who are guilty of such behavior will immediately be removed from the facility of “Think 2 Escape”. The police can be brought in if necessary.
  14. Anyone who intentionally ignores instructions give by ‚ÄúThink 2 Escape‚Ä̬† may be denied access to the facility of “Think 2 Escape”. The police can be brought in if necessary.
  15. It is forbidden to smoke at the facility of “Think 2 Escape” or in one of the escape rooms of “Think 2 Escape”. This also applies to the e-cigarette. Participants who do not comply with this prohibition will be removed from the facility of “Think 2 Escape”. The police can be brought in if necessary.
  16. It is not permitted to enter the facility of “Think 2 Escape” under the influence of drugs and / or alcohol. Participants who do not comply with this prohibition will be removed from the facility of “Think 2 Escape”. The police can be brought in if necessary.
  17. Participants who are in possession of drugs are denied access to the facility of “Think 2 Escape” or will be removed from the facility of “Think 2 Escape”. The police can be brought in if necessary.
  18. The possession of weapons and / or other dangerous objects or substances at the facility of “Think 2 Escape” is strictly forbitten. “Think 2 Escape” reserves the right to remove the owner of such objects or substances from the facility of “Think 2 Escape”. The police can be brought in if necessary.
  19. Persons who conceal their faces for more than two thirds by wearing a balaclava, burqa, scarf and hat combination or other since may be asked to remove their clothing covering their faces. This is done for security reasons. If the person in question refuses to comply with this request, access can be denied to and the person can be removed from the facility of “Think 2 Escape” without any right to a refund and / or other kind of compensation. Article 12: Complaints and disputes

  1. Complaints about the formation and / or implementation of the agreement must be fully and clearly described and submitted in writing to ‚ÄúThink 2 Escape‚ÄĚ within 6 weeks after the Customer has discovered or was able to identify the defects. Failure to timely submit the complaint means that the Customer loses his rights in this regard.
  2. If the Customer wishes to hold ‚ÄúThink 2 Escape‚ÄĚ responsible for damage suffered, the Customer must notify ‚ÄúThink 2 Escape‚ÄĚ in writing as soon as possible but within 6 weeks after the described damage applies. The nature and extent of the damage must be described as accurately as possible.
  3. ‚ÄúThink 2 Escape‚ÄĚ makes every effort, partly to prevent disputes, in the event of complaints and / or damage suffered by the Customer, to deal with this seriously and in all reasonableness, to the satisfaction of the Customer.
  4. Only a competent Dutch court is authorized to take cognizance of the disputes between “Think 2 Escape” and the Client.

Article 13: Other conditions

  1. Nullity of one of the provisions or members thereof in these General Terms and Conditions does not affect the validity of the other provisions or the other members. In that case, the invalid provisions or members thereof will be replaced by new provisions or members that correspond as much as possible with the old invalid provisions or members in terms of content, scope and purpose.
  2. All Agreements to which these General Terms and Conditions have been declared applicable are subject to Dutch law.
  3. These General Terms and Conditions are public.
  4. ‚ÄúThink 2 Escape‚ÄĚ is obliged to publicize the way in which the Client can obtain these General Terms and Conditions at his request.
  5. If requested, these conditions are also available free of charge from ‚ÄúThink 2 Escape‚ÄĚ, which can be consulted via the internet website of ‚ÄúThink 2 Escape‚ÄĚ: www.think2escape.nl.
